COMMITTEE OF INQUIRY INTO OPERATIONS OF THE TEMA DEVELOPMENT CORPORATION INSTRUMENT, 1984 (EI 3).

 

IN exercise of the powers conferred on the Provisional National Defence Council by subsection (1) of section 6 of the Provisional National Defence Council (Establishment) Proclamation (Supplementary and Consequential Provisions) Law, 1982 (P.N.D.C 42) this Instrument is made this 7th day of February, 1984.

Section 1—Establishment of Committee of Inquiry. 

There is hereby established a Committee of Enquiry to be known as the Committee of Inquiry into the Operations of the Tema Development Corporation hereafter referred to as "the Committee".

Section 2—Members of Committee.

The Committee shall consist of the persons specified in the Schedule to this Instrument.

Section 3—Terms of Reference.

The terms of reference of the Committee shall be as follows:—   

(a) to investigate any irregularities or acts of dishonesty in the allocation or sale of houses or shops in the Tema townships by the Tema Development Corporation;

(b) to investigate any irregularities or acts of dishonesty in the allocation of residential plots by the Tema Development Corporation in the township and surrounded areas;

(c) to investigate the transfer of sale by individuals of the houses; shops, or plots of allocated or sold to them by the Tema Development Corporation;

(d) to investigate any malpractices or acts of dishonesty by any member of the management staff and other personnel of the Tema Development Corporation;

(e) to investigate the award of contracts by the Tema Development Corporation for the construction and renovation of houses and shops of the Tema Development  Corporation in the Tema townships;

(f)  to review the laws and rules governing the operations of the Tema Development Corporation and also the existing organisational structure of the Tema Development Corporation.

(g) to investigate such other matters as in the opinion of the Committee are reasonably related or incidental to the foregoing; and

(h) to submit its findings and recommendations to the Provisional National Defence Council.

Section 4—Special Provision for Interim Measures.

Without Prejudice to paragraph 3 (h) of this Instrument the Committee shall have power to make recommendations and proposals to the Provisional National Defence Council for any interim disciplinary action to be taken against any member of the Corporation by way of, prosecutions before the Publics Tribunals or in court, dismissal, removal, retirement, or demotion at any time during the course of the deliberations of the Committee in respect of any matter which in the opinion of the Committee requires urgent attention.

Section 5—Secretary and Staff of the Committee.

(1) The Committee shall have a secretary who shall be a person appointed by the Secretary responsible for Works and Housing.

(2) The Secretary responsible for Works and Housing may provide to the Committee the services of such officers as the Committee may require for the discharge of its functions.

Section 6—Meetings of Committee.

(1) The Committee shall meet at such times and at such places as it may determine.

(2) The Committee may at any time engage the services of any person to attend any of its meetings as its adviser.

(3) Subject to the provisions of this Instrument the Committee shall regulate its own procedure.

Section 7—Quorum.

The Committee shall at any time be deemed to be duly constituted if not less than three members are present.

Section 8—Witnesses.

(1) The Committee may require any person:—

(a) to attend at such time and place as may be indicated by the Committee to give evidence or produce any document in his possession or control relates to any matter indicated by the Committee; or

(b) to give to the Committee any information that it may require for the purpose of any investigation before it.

(2) Any person who appears before the committee under sub-paragraph (1) of this paragraph may be examined on oath and the Committee may for that purpose administer the oath.

Section 9—Offences.

Any person who—

(a) refuses or wilfully neglects to attend in obedience to a requirement by the Committee under sub-paragraph (1) (a) of paragraph 8 of this Instrument, or give evidence as required thereunder; or

(b) wilfully alters, suppresses, conceals, destroys or refuses to produce any document which he is required to produce under sub-paragraph (1) (a) of paragraph 8 of this Instrument; or

(c) refuses or wilfully neglects to finish any information required of him under sub-paragraph 8 of this Instrument,

is guilty of an offence and liable on summary conviction to a fine not exceeding ¢5,000.00 or to imprisonment not exceeding six months or to both.
