IN exercise of the powers
conferred on the Provisional
National Defence Council by
subsection (1) of section 6 of the
Provisional National Defence
Council (Establishment)
Proclamation (Supplementary and
Consequential Provisions) Law,
1982 (P.N.D.C 42) this Instrument
is made this 5th day of July,
1984.
Section 1—Establishment.
There is hereby established a
Committee of Enquiry to be known
as the West African Examinations
Council Committee of Enquiry
hereafter referred to as " the
Committee ".
Section 2—Membership.
The Committee shall consist of the
persons specified in the Schedule
to this Instrument.
Section 3—Terms of Reference.
The terms of reference of the
Committee shall be as follows:—
(a) to investigate the leakage of
question papers for the 1984 May
and June School Certificate and
General Certificate of Education
examinations in Ghana and
establish culpability where
necessary;
(b) to identify the nature,
causes and sources of the
leakages;
(c) to examine the security
arrangements in the Accra Office
of the West African Examinations
Council and recommend necessary
improvements;
(d) to inquire into any other
matter which appears to the
Committee to be reasonably related
to the foregoing and which the
Committee is satisfied requires to
be inquired into; and
(e) to submit its findings to the
Provisional National Defence
Council giving reasons therefor
and making such recommendations to
the Council in respect of its
findings as the Committee may find
appropriate.
Section 4—Secretary.
(1) Mr. E. T. Akyianu, Principal
Secretary, Ministry of Education,
shall act as Secretary to the
Committee.
(2) The Provisional National
Defence Council may provide to the
Committee the Services of such
officers as the Committee may
require for the discharge of its
functions.
Section 5—Meetings of Committee.
(1) The Committee shall meet at
such times and at such places as
it may determine and shall sit in
camera where necessary.
(2) Subject to the provisions of
this Instrument, the Committee
shall regulate its own procedure.
Section 6—Witnesses.
(1) The Commit" may require any
person—
(a) to attend at such time and
place as may be indicated by the
Committee to give evidence or to
produce any document in his
possession or control which
relates to any matter indicated by
the Committee; or
(b) to give to the Committee any
information that it nay require
for the purpose of any
investigation before it.
(2) Any person who appears before
the Committee under sub-paragraph
(1) of this paragraph may be
examined on oath and the Committee
may for that purpose administer
the oath.
Section 7—Offences.
Any person who—
(a) refuses or wilfully neglects
to attend in obedience to a
requirement by the Committee under
paragraph 6 (1) (a) or to give
evidence as required thereunder;
or
(b) wilfully alters, suppresses,
conceals, destroys or refuses to
produce any document which he is
required to produce under
paragraph 6 (1) (a); or
(c) refuses or wilfully neglects
to furnish any information
required of him under
sub-paragraph 6 (1) (b),
is guilty of an offence and liable
on summary conviction to a fine
not exceeding ¢5,000.00 or to
imprisonment not exceeding six
months or to both.
Section 8—Police Officers to
Assist Committee.
The Inspector General of Police
shall detail Police Officers to
attend upon the Committee, to
preserve order during proceedings
of the Committee, to serve
summonses on witnesses and to
perform any other functions
relating to the work of the
Committee as the Committee may
direct.
