COMMITTEE OF INQUIRY (SONGOR LAGOON) INSTRUMENT, 1985 (EI 12).

 

IN exercise of the powers conferred on the Provisional National Defence Council by subsection (1) of section 6 of the Provisional National Defence Council (Establishment) Proclamation (Supplementary and Consequential Provisions) Law, 1982 (P.N.D.C.L. 42) this Instrument is made this 23rd day of September, 1985.

Section 1—Establishment of Committee of Inquiry.

There is hereby established a Committee of Inquiry to be known as the "Committee of Inquiry (Songor Lagoon)" in this Instrument referred to as the "Committee".

Section 2—Members of the Committee.

The Committee shall consist of the persons specified in the Schedule to this Instrument.

Section 3—Terms of Reference.

The terms of reference of the Committee shall be as follows—

(a) to investigate grievances and complaints to the people of Ada Traditional Area in relation to the operation in the Songor Lagoon by Vacuum Salt and Star Chemical Co. Ltd;

(b)  to investigate whether the operation of these companies has resulted in undue hardship to the people in the area and to make recommendations to redress such hardship, if any;

(c)  to investigate to what extent the operations of Vacuum Salt and Star Chemical Co. Ltd. are preventing the people of the area from developing their own portion of the lagoon;

(d)  to inquire into any other matter which in the opinion of the Committee is reasonably related to the foregoing and which the Committee is satisfied should be inquired into; and

(e)  to submit its findings to the Provisional National Defence Council giving reasons and making such recommendations to the Council in respect of its findings as the Committee may find appropriate.

Section 4—Secretary and Staff of Committee.

(1) Mr. E. C. Kotey, Acting Chief Director, Ministry of Defence shall act as Secretary to the Committee.

(2) The Provisional National Defence Council may provide to the Committee the Services of such officers as the Committee may require for the discharge of its functions.

Section 5—Meeting of Committee.

(1)  The Committee shall meet at such times and such places as it may determine.

(2)  The Committee may at any time engage the services of any person to attend any of its meetings as an adviser.

(3) Subject to the provisions of this Instrument the Committee shall regulate its own procedure.

Section 6—Quorum.

The Committee shall at any time be deemed to be duly constituted if the Chairman and one other member are present.

Section 7—Witnesses.

(1) The Committee may require any person—

(a) to attend at such time and place as may be indicated by the Committee to give evidence or produce any document in his possession or control which relates to any matter indicated by the Committee; or

(b) to give to the Committee any information that it may require for the purpose of any investigation before it.

(2) Any person who appears before the Committee under subparagraph (1) of this paragraph may be examined on oath and the Committee may for that purpose administer the oath.

Section 8—Offence.

Any person who—

(a) refuses or wilfully neglects to attend in obedience to a requirement by the Committee under subparagraph (1) (a) of paragraph 7 of this Instrument, or to give evidence as required thereunder; or

(b) wilfully alters, suppresses, conceals, destroys or refuses to produce any document which he is required to produce under subparagraph (1) (a) of paragraph 7 of this Instrument; or

(c) refuses or wilfully neglects to furnish any information required of him under subparagraph (1) (b) of paragraph 7 of this Instrument, is guilty of an offence and liable on summary conviction to a fine not exceeding ¢5,000.00 or to imprisonment not exceeding six months or to both.
