IN exercise of the powers
conferred on the Secretary
responsible for the Interior by
section 2 of the Public Order
Decree, 1972 (NRCD 68) this
Instrument is made this 2nd day of
July, 1986.
Section 1— Prohibition of
Manufacture, Possession and
Carrying of Arms.
No person shall manufacture,
possess or carry any arms or
ammunition within the Awudome and
Peki Traditional Areas in the
areas of authority of the Ho and
Kpandu District Councils
respectively.
Section 2— Military, Police and
Prisons Personnel on Duty
Exempted.
Paragraph 1 of this Instrument
shall not apply to the following:
(a) a member of the Armed Forces
on duty;
(b) a member of the Police Force
on duty;
(c) a member of the Prisons
Service on duty;
(d) a person duly authorised in
writing by the Secretary
responsible for the Interior.
Section 3—Deposit of Arms and
Ammunition with the Police.
(1) Any person who on the coming
into force of this instrument is
in possession of any arms or
ammunition within the Awudome and
Peki Traditional Areas shall on
the coming into force of this
Instrument deposit such arms and
ammunition with the
Officer-in-Charge of the nearest
Police Station.
(2) The police officer-in-charge
of the police station where any
arms or ammunition are deposited
shall register, label and store
properly all such arms or
ammunition deposited and he shall
be personally held liable for any
loss of or damage to any such arms
or ammunition.
(3) Any arms or ammunition
deposited under sub-paragraph (1)
of this paragraph shall be
returned to the persons entitled
thereto when this Instrument is
revoked or otherwise ceases to
have effect.
Section 4—Police Officer to Arrest
without Warrant.
A
police officer may search or
arrest without warrant any person
whom he suspects on reasonable
grounds of manufacturing,
possessing or carrying arms or
ammunition in contravention of the
provisions of this Instrument.
Section 5—Offence.
A
person who contravenes any
provision of this Instrument
commits an offence and is liable
to a fine not exceeding ˘5,000.00
or to imprisonment for a term not
exceeding three years or to both.
Section 6—Interpretation.
In this instrument:—
“ammunition” include explosives,
all munitions of war and all
materials for loading firearms;
“arms” includes firearms and
offensive weapons of all
descriptions, artillery, apparatus
for the discharge of all kinds of
projectiles, explosives or
gas-diffusing flame-throwers,
bombs, grenades, machine-guns and
rifled small-bore breech-loading
weapons all of kinds, and includes
also all parts of any of the
foregoing;
“firearms” includes any gun,
rifle, machine-gun, cap-gun,
flint-lock gun or pistol,
revolver, pistol cannon or other
firearms and any air gun, air
rifle or air pistol whether whole
or in detached pieces;
“offensive weapon” means an
article made or adapted for
causing injury to the person or
intended by the person having it
with him for such use by him.

DELLA GUARDIA DIDIER DEPORTATION
ORDER, 1986 (EI 11).
WHEREAS DELLA GUARDIA DIDIER, an
alien, was convicted on 22nd
April, 1986 at Ashanti Regional
Tribunal of an offence punishable
by imprisonment with the option of
a fine.
AND WHEREAS the Chairman of the
said Tribunal has recommended that
the said DELLA GUARDIA DIDIER be
deported and the recommendation
has been concurred in by the Chief
Justice.
NOW THEREFORE, in exercise of the
powers conferred on the PNDC
Secretary responsible for the
Interior by section 13 of the
Aliens Act, 1963 (Act 160), the
Order is made this 16th day of
July, 1986.
DELLA GUARDIA DIDIER is hereby
ordered to leave Ghana after the
completion of his sentence and
thereafter to remain out of Ghana.
