COMMITTEE OF INQUIRY INTO THE GRIEVANCES OF THE WEIJA IRRIGATION CO-OPERATIVE FARMERS MARKETING SOCIETY LIMITED INSTRUMENT, 1988 (EI 36).

 

IN exercise of the powers conferred on the Provisional National Defence Council by subsection (1) of section 6 of the Provisional National Defence Council     (Establishment)  Proclamation (Supplementary and Consequential Provisions) Law, 1982 (P.N.D.C.L. 42) this Instrument is made this 30th day of July, 1988.

1. There is hereby established a Committee of Inquiry to be known as the "Committee of Inquiry into the grievances of Weija Irrigation Co-operative Farmers Marketing   Society  Limited" hereafter referred to as "the Committee".

2. The Committee shall consist of the persons specified in the Schedule to this Instrument.

3.  The terms of reference of the Committee shall be as follows —

(a) to investigate the mode of acquisition of the land for the Weija Irrigation Project and in particular whether any provision was made for future expansion of the village;

(b) to investigate the payment of rent by the farmers and the criteria for the determination of rent;

(c) to investigate the mode of  allocation of plots and optimum farm size per farmer;

(d) to review the cost structure, both fixed and operational cost and to assist the Weija Irrigation Company to minimise the fixed (overhead) component to reflect in the prices of inputs and services delivered to the farmers;

(e)  to review the costs of administration of credit facilities to the farmers and to develop appropriate norms including the need for risk cover and the involvement of the lending institutions in extending credit facilities to the farmers;

(f)  to investigate the extent to which the Weija irrigation Company is providing satisfactory management services to the farmers in deciding whether the Company has an adequate accounting and control system as well as internal and external capability to maintain and implement the project profitably;

(g) to examine the extent of the Weija Irrigation Co-operative Farmers Marketing   Society's technical capability in such areas as farm management, accounting, marketing, purchasing, distribution, personnel management and financing;

(h) to investigate the extent to which the Weija Irrigation Company is working towards the attainment of the objectives of the project, that is the regular production and supply of vegetables to Accra Tema areas; and

(i)  to submit its findings and recommendations within two months from the date of its inauguration.

4.  (1) Mr. B. C. Attipoe of the Irrigation Development Authority shall be the Secretary of the Committee.

(2) The Provisional National Defence Council may provide to the Committee the services of such other officers as the Committee may require for the discharge of its functions.

5.   (1)  The Committee shall meet at such times and such places as it may determine.

(2) The Committee may at any time engage the services of any person to attend any of its meetings as an adviser.

(3)  Subject to the provisions of this Instrument, the Committee shall regulate its own procedures.

6.  The Committee shall at any time be deemed to be duly constituted if the Chairman and three other members are present.

7.  (1)  The Committee may require any person—

(a)  to attend at such time and place as may be indicated by the Committee to give evidence or produce any document in his possession or control which relates to any matter indicated by the Committee; or

(b) to give to the Committee any information that it may require for the purpose of any investigation before it.

(2) Any person who appears before the Committee under subparagraph (1) of this paragraph may be examined on oath and the Committee may for that purpose administer the oath.

8.   Any person who—

(a) refuses or wilfully neglects to attend in obedience to a requirement by the Committee under subparagraph (1) (a) of paragraph 7 of this Instrument, or

(b) wilfully alters, suppresses, conceals, destroys or refuses to produce any document which he is required to produce under subparagraph (l) (a) of paragraph 7 of this Instrument; or

(c) refuses or wilfully neglects to furnish any information required of him under subparagraph (1) (b) of paragraph 7 of this Instrument,

is guilty of an offence and liable on summary conviction to a fine not exceeding ¢5,000.00 or to imprisonment not exceeding six months or to both.
