GHANA SEAMEN’S EMPLOYMENT AND WELFARE BOARD (AMENDMENT) RULE, 1988 (EI 8).

 

IN exercise of the powers conferred on the Secretary responsible for Shipping by section 308 of the Merchant Shipping Act, 1963 (Act 183) this Rule is made this 16th day of March, 1988.

The Ghana Seamen’s Employment and Welfare Board Rules, 1974 (E.I. 77) are hereby amended as follows—

(a) by the substitution for sub-rule (1) of Rule 14 thereof of the following new sub-rule:

“Penalty for Unlawful Employment of Seamen

14. (1)  Except in an emergency any ship owner who employs any seamen in Ghana   without directing such employment through the appropriate Employment Centre shall be guilty of an offence and liable on summary conviction to a fine not exceeding ˘5,000.00 or to imprisonment for a term not exceeding six months or to both in respect of each seaman unlawfully engaged”;

(b) by the substitution for sub-rule (2) of Rule 19 thereof of the following new sub-rule:

“(2) Any Master or other officer who refuses to assist the Employment Centre Superintendent or his representative as required under sub-rule (1) of this Rule shall be guilty of an offence and on summary conviction be liable to a fine not exceeding ˘500.00.”
