EI 12     PUBLIC ORDER (PROHIBITION OF ARMS AND AMMUNITION), INSTRUMENT, 2007

 

IN exercise of the powers conferred on the Minister responsible for the Interior by section 5 (1) of the Public Order Act, 1994 (Act 491) this Instrument is made this 2nd day of November, 2007.

 

Prohibition of possession of arms

      1. (1) A person shall not manufacture, procure, possess or carry any arms or ammunition within the areas specified in the Schedule.

 

(2) Sub-paragraph (1) does not apply to:

(a) a member of the Armed Forces;

(b) a member of the Police Service;

(c) a member of the Ghana Prisons Service;

(d) a member of the Security and Intelligence Service;

(e) a member of the Ghana Immigration Service;

(f) a member of the Customs Excise and Preventive Service; or

(g) any other person duly authorised by the Minister responsible for the

      Interior to undertake a specified assignment.

 

(3) Despite the provisions of sub-paragraph (1), a person may manufacture, procure, possess or carry arms or ammunition if that person satisfies the Minister or the person authorised by the Minister that that person has lawful authority for the manufacture, procurement, possession or carrying of the arms or ammunition and the arms or ammunition is not intended for use within the area specified in the Schedule.

 

Deposit of arms and ammunition with the police

 

      2. A person who is in possession of arms or ammunition or has arms or ammunition under that person's control within the area specified in the Schedule shall deposit the arms or ammunition with the officer in charge of the nearest police station.

 

Power of search without warrant

      3. A police officer or a person authorised by the Minister responsible for the Interior, may within the area specified in the Schedule, search and arrest without warrant any person whom the police officer or that authorised person suspects on reasonable grounds to be in possession of or carrying arms or ammunition in contravention of this Instrument.

 

Offences and penalties

      4. A person who

(a) manufactures, procures, possesses or carries arms or ammunition contrary to paragraph 1 (1); or

(b) fails to deposit arms or ammunition contrary to paragraph 2

commits an offence and is liable on summary conviction to a fine of not more than two hundred penalty units or to a term of imprisonment of not more than twelve months or to both.

 

Interpretation

      5. In this Instrument unless the context otherwise requires "ammunition" includes explosives, all munitions of war and all materials for loading firearms;

 

"arms" includes firearms and offensive weapons of all descriptions, artillery, apparatus for the discharge of any kind of projectile, explosives or gas-diffusing, flame throwers, bombs, grenades, machine-guns and rifle, small-bore breech-loading weapons of any kind and includes parts of any of the foregoing materials;

 

"firearms" includes any gun, rifle, machine-gun, flint-lock gun or pistol, revolver, cannon or other firearms and any air gun, air rifle or air-pistol whether whole or in detached pieces; and

 

"offensive weapon" means an article made or adapted to cause injury to a person or intended by the person having the article to cause injury to a person.
