IN exercise of the powers
conferred on the Commissioner
responsible for the Interior by
section 28 of the Aliens Act, 1963
(Act 160) these Regulations are
made this 23rd day of August,
1974.
Regulation 1—Regulation 7 of L.I.
265 Amended
The Aliens Regulations, 1963 (L.I.
265) as amended by the Aliens
(Amendment) (No. 2) Regulations,
1971 (L.I. 692) are hereby further
amended by the substitution for
regulation 7 thereof of the
following new regulation:—
"7. Residence Permit.
(1) Subject to the other
provisions of this regulation, the
immigration officer may grant a
residence permit to an alien
desiring to take up or continue in
employment in Ghana or to engage
in any trade, business or
profession or who otherwise
desires to remain in Ghana for an
indefinite or substantial period,
and subject as aforesaid, any such
permit may from time to time be
renewed.
(2) A residence permit shall be
subject to the condition that the
person to whom it is granted shall
not undertake any employment or
engage in any business, trade or
profession except as may be
specified (if any) in the permit.
(3) A residence permit or a
renewal of a residence permit
shall be for such period as the
immigration officer many decide,
so however that except where the
Commissioner otherwise directs, a
residence permit shall be for a
period not exceeding two years and
a renewal thereof shall not exceed
one year at a time.
(4) There shall be charged for the
grant of a residence permit a fee
of fifty cedis and for each
renewal there shall be charged a
fee of ten cedis:
Provided that the fee for a
renewal shall be the same as for
the original permit unless the
application for the renewal was
made within one month prior to the
expiration of the original
licence.
(5) No fee shall be paid by farm
labourers in respect of the issue
of a residence permit.
(6) The immigration officer may
issue a residence permit to a wife
or other dependant of a person to
whom a residence permit has been
issued (hereinafter referred to as
the principal holder) subject to
the condition that the person to
whom it is issued shall not
undertake or follow any occupation
for reward (other than part-time
or full-time employment for
renumeration with the express
permission of the Commissioner)
and subject to any other
conditions to which the principal
holder's permit is subject.
(7) A residence permit granted to
a principal holder's dependant
shall be for a period not
exceeding that applicable to the
principal holder's permit or the
residue thereof ".
Regulation 2—Revocation.
The Aliens (Amendment) (No. 2)
Regulations, 1971 (L.I. 692) are
hereby revoked.
Regulation 3—Commencement
These Regulations shall come into
force on the 23rd day of August,
1974.
