  BANKING REGULATIONS, 1973 (LI 830).

 

IN exercise of the powers conferred on the Commissioner responsible for Finance by section 40 of the Banking Act, 1970 (Act 339), after consultation with the Bank of Ghana these Regulations are made this 12th day of July, 1973.

Regulation 1—Advances to Firms Bank’s Directors have Interest.

(1) No bank shall grant to any firm or company in which any of the directors of that bank is interested as a partner, a guarantor or is one of the principal shareholders any unsecured loan or unsecured credit facility in excess of, in the aggregate and outstanding at any one time, twenty per centum of the annual turnover of such firm or company for the previous year.

(2) For the purposes of sub-regulation (1) of this regulation “principal shareholder” means a person owning not less than thirty per centum of the capital of the firm or company concerned.

Regulation 2—Advances to Bank’s Directors.

No bank shall grant in any one year to any of the directors of such bank any unsecured advances or unsecured credit facilities exceeding the annual fees payable to that director by the bank.

Regulation 3—Commercial, Agricultural, Etc., Activities of Banks.

The provisions of subsection (1) of section 12 of the Act shall not apply where a bank with the approval in writing of the Bank of Ghana engages in commercial, agricultural or industrial undertaking as a model, for experiment, research or educational purposes.

Regulation 4—Disposition of Bank’s Interest.

Where a bank lawfully acquires any interest in satisfaction of a debt due to it under subsection (3) of section 12 of the Act but fails to dispose of such interest within one year after the acquisition of that interest it shall apply in writing to the Bank of Ghana stating—

(a) the nature and value of the said interest;

(b) the reasons why the said interest was not disposed of within the prescribed period;

(c) a reasonable period within which the said interest may be disposed of.

Regulation 5—Banks to Submit Returns.

Every bank shall submit to the Bank of Ghana—

(a) not later than twenty-one days after the end of the last day of every month a statement in Form BEX-5 set out in Part I of the Schedule to these Regulations showing the bank's assets and liabilities as at the close of business on such last day; and

(b) not later than twenty-one days after the end of the last day of every month a statement in Form BEX-6 set out in Part II of the Schedule to these Regulations showing an analysis of loans, advances and overdrafts granted by that bank during every such month and for the six-month period ending respectively in June and December.

Regulation 6—Interpretation.

In these Regulations—

“Act” means the Banking Act, 1970 (Act 339);

“bank” has the meaning assigned to it by section 47 of the Act.

Date of Gazette Notification: 20th July, 1973.

CHIEFTAINCY (PROCEEDINGS AND FUNCTIONS) (TRADITIONAL COUNCILS) REGULATIONS, 1973 (LI 827).

WHEREAS by section 28 (2) of the Chieftaincy Act, 1971 (Act 370), the jurisdiction conferred on Traditional Councils by section 15 of the said Act is required to be exercised by a Judicial Committee:

AND WHEREAS the said section 28 (2) provides that the provisions of the said Act relating to the proceedings and functions of a judicial committee of a Regional House of Chiefs should apply to the proceedings and functions of  a judicial committee of a Traditional Council with such modifications as may be prescribed by the Commissioner by regulations made under section 62 of the said Act:

AND WHEREAS the Commissioner is satisfied that the appearance of Counsel before judicial committees of Traditional Councils is for the time being inexpedient:

NOW THEREFORE in exercise of the powers conferred on the Commissioner responsible for Chieftaincy matters by section 62 of the Chieftaincy Act, 1971 (Act 370) this Regulation is made this 27th day of  June, 1973.

Regulation 1—Section 24 (4) of Act 370 modified in its Application to Judicial Committees of Traditional Councils.

Subsection (4) of section 24 of the Chieftaincy Act, 1971 (Act 370) shall, in its application to judicial committees of Traditional Councils be deemed to have been modified so as to read as follows:—

“Any party to proceedings before a judicial committee of a Traditional Council or any person required or entitled to appear before such a committee shall appear in person and not by Counsel.”
