 PRICE CONTROL REGULATIONS, 1976 (LI 1068).

 

IN exercise of the powers conferred on the Commissioner responsible for Trade acting on the advice of the Prices and Incomes Board by section 17 of the Price Control Decree, 1974 (N.R.C.D. 305) these Regulations are made this 11th day of March, 1976.

Regulation 1—Display of List of Controlled Prices.

(1) Every person who carries on a trade or business involving the selling of any goods in relation to which a price control order has been made under the Price Control Decree, 1974 (N.R.C.D. 305) shall, for the information of the public, at all times keep a copy of the current lists of controlled prices openly displayed on the premises where he sells the goods.

(2) Every local authority or other person who builds, maintains or operates a market shall at all times keep copies of the current lists of controlled prices openly displayed at the entrance to the market and in such other places within or outside the market as the Commissioner may direct.

(3) The lists of controlled prices referred to in sub-regulation (1) and (2) shall be displayed in such form and manner as the Commissioner may direct.

(4) Any person who contravenes any provision of this regulation or who, without the authority of the Commissioner or of an inspector or of any other person authorised in that behalf by the Commissioner removes, defaces, mutilates or intermeddles with a list displayed in accordance with this regulation shall be guilty of an offence and liable on conviction to a fine not exceeding 200.00 or to imprisonment not exceeding twelve months or to both.

Regulation 2—Marking of Prices.

(1) Except in such cases as the Commissioner may determine and subject to the provisions of this regulation, every person who carries on a trade or business involving the sale of any goods shall mark the goods with the prices at which they are offered for sale.

(2) The price marked on one article for the purposes of this regulation shall apply to all similar articles offered for sale by the same person at the same time and where the goods are sold by quantity the price per unit of sale shall be marked.

(3) A person shall be deemed to comply with sub-regulation (1) of this regulation if he affixes or otherwise places the price of the goods in such relationship with those goods as to inform persons wishing to buy the goods of their price without the need for such persons to ask their price from the seller.

(4) Any person who contravenes any provision of this regulation shall be guilty of an offence and liable on conviction to a fine not exceeding 200.00 or to imprisonment not exceeding twelve months or to both.

Regulation 3—Inspectors.

Any person appointed by a certificate issued in the form specified in the Schedule to these Regulations and signed by or on behalf of the Commissioner may act as an inspector for the purpose of enforcing the provisions of the Price Control Decree, 1974 (N.R.C.D. 305):

Provided that a police officer may act as such inspector without a certificate if he acts in accordance with section 13(4) of the said Decree.

Regulation 4—Revocations.

The following instruments are hereby revoked:—

Control of Prices (Inspectors) Regulations, 1962 (LI 180)

Control of Prices (Display of Price List and Marking of Prices) Regulations, 1962 (LI 181)

Control of Prices (Display of Price List and Marking of Prices) (Amendment) Regulation, 1965 (LI 479).

This is to certify that ................................... has been appointed an inspector for the purposes of enforcing the provisions of the Price Control Decree, 1974 (N.R.C.D. 305) and is authorised to enter and inspect premises under section 13 of that Decree and to exercise all the powers conferred on inspectors by that section.
